Exploration Licences and Assessment Leases

An application for the renewal of an exploration licence or an assessment lease must be lodged with the Secretary within the period of 2 months before the licence or lease ceases to have effect.

Exploration Licences and Assessment Leases take effect on the date on which it is granted or on such later date, or on the occurrence of such later event, as the decision-maker may determine, and ceases to have effect on the expiration of:

  1. 2 years after the date on which it took effect, in the case of an exploration (mineral owner) licence or assessment (mineral owner) lease, or
  2. such period (not exceeding 6 years) as the decision-maker determines, in the case of any other exploration licence or assessment lease.

Mining Leases

An application for the renewal of a mining lease for:lease:

  1. for 1 year ofor less must be lodged with the Secretary within the period of 2 months before the lease ceases to have effect
  2. for more than 1 year must be lodged with the Secretary not earlier than 5 years and not later than 1 year before the lease ceases to have effect.

Mining leases:

  1. take effect on the date on which it is granted or on such later date as the decision-maker may determine, and
  2. cease to have effect at the expiration of such period as the decision-maker determines, being a period that must not exceed 21 years, except with the Premier’s concurrence.

Mineral Claims

An application for the renewal of a mineral claim:

  1. must be accompanied by the application fee prescribed by the regulations, and
  2. must be lodged with the Secretary within 2 months before the day on which the claim would otherwise expire.

If an application for renewal of a mineral claim is not finally dealt with before the date on which the mineral claim would otherwise cease to have effect, the mineral claim continues to have effect in relation to the land to which the application relates (and no other land) until the application is finally determined.

A mineral claim:

  1. takes effect on the date on which it is granted or on such later date as the Secretary may determine, and
  2. ceases to have effect at the expiration of such period (not exceeding 5 years or, in the case of a mineral claim over land that is situated within a mineral claims district, not exceeding such shorter period as the special conditions may specify) as the Secretary may determine.
